HBA-CMT, JEK H.B. 1184 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1184 By: Tillery Urban Affairs 3/12/2001 Introduced BACKGROUND AND PURPOSE Currently, officers in the Dallas Police Department are required to flex their work schedules whenever possible to accommodate the administration's concerns regarding the utilization of overtime. Conversely, police administrators in the appointed ranks of the Dallas Police Department are able to have overtime schedules and may eventually receive cash for the compensatory time after a certain time period. House Bill 1184 prohibits the Dallas Police Department from paying overtime or time accumulation to salaried management employees. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1184 amends the Local Government Code to prohibit an employee of a police department, subject to the federal Fair Labor Standards Act of 1938, from receiving compensation for overtime or compensatory time off if the employee is a police officer who has a rank above the rank of captain or is a civilian employee who receives a salary greater than the lowest base salary that the municipality pays a captain, and the appointment to the employee's current rank or position was not based at least in part on performance on a competitive examination. The provision applies only to a municipality with a population of one million or more that has not adopted the provisions for municipal civil service. EFFECTIVE DATE September 1, 2001.
