BACKGROUND AND PURPOSE 

There are current provisions that relate to treason in the Code of Criminal
Procedure.  However, the offense of treason is no longer in the Penal Code.
It is considered beneficial for legal purposes to simplify and promote
consistency within the Penal Code and to remove these articles from the
Code of Criminal Procedure.  House Bill 1186 repeals current law in the
Code of Criminal Procedure relating to treason. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 1186 amends the Code of Criminal Procedure to repeal law
requiring the testimony of two witnesses for a conviction of treason and
repeals law prohibiting the admittance of evidence for an overt act that is
not expressly charged in an act of treason. 

EFFECTIVE DATE

On passage, or if the Act does not receive the necessary vote, the Act
takes effect September 1, 2001.
