SRC-CTC H.B. 1276 77(R) BILL ANALYSIS Senate Research Center H.B. 1276 77R5805 BDH-DBy: Crownover, Myra (Fraser) Education 5/11/2001 Engrossed DIGEST AND PURPOSE Currently, a parent enrolling a child in school is required to present legal documentation of the child's identity. Schools use a student's legal name in attendance, immunization, and other records. Sometimes a student or parent will request that a student be identified by a name other than the student's legal name. As a result, schools may become embroiled in family disputes that do not relate to educating children. H.B. 1276 requires a student's legal surname to be used in the classroom. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 25A, Education Code, by adding Section 25.0021, as follows: Sec. 25.0021. USE OF LEGAL SURNAME. Requires a student, in each public school, to be identified by the student's legal surname as that name appears on certain official documents. SECTION 2. Makes application of this Act prospective to the 2001-2002 school year. SECTION 3. Effective date: upon passage or September 1, 2001.
