SRC-BWC H.B. 1314 77(R) BILL ANALYSIS Senate Research Center H.B. 1314 77R9295 GWK-DBy: Hopson (Staples) Criminal Justice 4/29/2001 Engrossed DIGEST AND PURPOSE Inmates classified as sex offenders by the Texas Department of Criminal Justice (TDCJ) sometimes file grievances and lawsuits, often at taxpayer expense, that argue that TDCJ does not have statutory authority to require the inmates to participate in sex offender treatment programs. H.B. 1314 gives TDCJ statutory authority to require an inmate to participate in a treatment program. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 500, Government Code, by adding Section 500.004, as follows: Sec. 500.004. PARTICIPATION IN TREATMENT PROGRAM. Requires an inmate required by law or department policy to participate in a treatment program to participate in the program. SECTION 2. Effective date: upon passage or September 1, 2001.
