HBA-TBM H.B. 1314 77(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 1314 By: Hopson Corrections 7/25/2001 Enrolled BACKGROUND AND PURPOSE Prior to the 77th Legislature, inmates classified as sex offenders by the Texas Department of Criminal Justice (TDCJ) sometimes filed grievances and lawsuits, often at taxpayer expense, that argued that TDCJ did not have statutory authority to require the inmates to participate in sex offender treatment programs. House Bill 1314 gives TDCJ statutory authority to require an inmate to participate in a treatment program. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1314 amends the Government Code to provide that an inmate who is required by law or the Texas Department of Criminal Justice policy to participate in a treatment program is required to participate in the program. EFFECTIVE DATE September 1, 2001.
