SRC-CTC H.B. 1316 77(R) BILL ANALYSIS Senate Research Center H.B. 1316 77R5841 SMJ-FBy: Farabee (Moncrief) Health & Human Services 5/9/2001 Engrossed DIGEST AND PURPOSE Currently, the first $50,000 of a trust that belongs to a client of a mental health community center or a patient at a state hospital is not liable for the client's or patient's support. H.B. 1316 raises the amount at which a trust becomes liable for a patient's or client's care to $250,000. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 534.0175(a), Health and Safety Code, to increase the maximum amount of the aggregate principal of a trust from $50,000 to $250,000 the corpus or income of which is not to be considered to be the property of a client that is liable for the client's support. Makes a conforming change. SECTION 2. Amends Section 552.018(a), Health and Safety Code, to make conforming changes. SECTION 3. Effective date: upon passage or September 1, 2001.
