HBA-JEK, NRS H.B. 1316 77(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 1316 By: Farabee Public Health 7/10/2001 Enrolled BACKGROUND AND PURPOSE Prior to the 77th Legislature, state law provided that the first $50,000 of a trust that belonged to a client of a mental health community center or a patient at a state hospital was not liable for the client's or patient's support. House Bill 1316 raises the amount at which a trust becomes liable for a patient's or client's care to $250,000. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1316 amends the Health and Safety Code to increase from $50,000 to $250,000 the amount of principal of a trust held by a client of a mental health community center or a patient of a state hospital that is not considered to be the client's or the patient's property and is not liable for the client's or patient's support. EFFECTIVE DATE September 1, 2001.
