HBA-SEP H.B. 1321 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1321 By: Brimer Economic Development 3/20/2001 Introduced BACKGROUND AND PURPOSE Current law authorizes the Texas Workforce Commission to award unemployment benefits to substitute school teachers. House Bill 1321 provides that substitute teachers not employed on more than a day-to day basis are ineligible for unemployment benefits. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1321 amends the Labor Code to provide that, under the Texas Unemployment Compensation Act, "employment" does not include service performed for a school district by an individual employed as a substitute for a regularly employed teacher if the substitute is notified in writing by the school district, at the time of hiring, that the position is temporary; and there is no reasonable assurance that the individual will be offered employment on more than a day-to-day basis. EFFECTIVE DATE September 1, 2001 contingent on the passage of federal legislation establishing the ineligibility of certain substitute teachers to receive unemployment compensation benefits.
