SRC-TBR H.B. 1506 77(R) BILL ANALYSIS Senate Research Center H.B. 1506 77R5748 AJA-DBy: Yarbrough (Whitmire) Business & Commerce 4/25/2001 Engrossed DIGEST AND PURPOSE Currently, if an elected officer of the state files a protest with the Texas Alcoholic Beverage Commission requesting that the commission refuse an application for a license, the elected official must pay a security bond. H.B. 1506 exempts an elected officer of the state or federal government from being required to file a security bond, when contesting an application for an alcoholic beverage license. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 61.39, Alcoholic Beverage Code, to prohibit security for costs of a contested alcoholic beverage license application from being required of an officer of a county or incorporated city or town or an elected officer of the state or federal government. Makes a nonsubstantive change. SECTION 2. Effective date: September 1, 2001.
