HBA-DMH H.B. 1506 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1506 By: Yarbrough Licensing & Administrative Procedures 6/12/2001 Enrolled BACKGROUND AND PURPOSE Prior to the 77th Legislature, if an elected official filed a protest with TABC requesting that TABC refuse an application for a license, the elected official had to pay a security bond. If the security bond was not on file, a case decided against an applicant could have been reversed by a court of appeals. House Bill 1506 exempts an elected officer of the state or federal government from filing a security bond. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1506 amends the Alcoholic Beverage Code to exempt an elected officer of the state or federal government from being required to file a security bond when the officer contests the facts stated in an application for a license to distribute, manufacture, or sell beer at retail, or the applicant's right to secure a license. EFFECTIVE DATE September 1, 2001.
