SRC-JBJ H.B. 1584 77(R) BILL ANALYSIS Senate Research Center H.B. 1584 77R5793 GWK-DBy: Gallego (Armbrister) Criminal Justice 5/8/2001 Engrossed DIGEST AND PURPOSE One primary role of the Board of Pardons and Paroles (board) is to administer the discretionary release of eligible inmates sentenced to the institutional division of the Texas Department of Criminal Justice. Although the board's duties include the determination of the conditions of release to mandatory supervision, it is unclear whether the board has the duty to determine which prisoners are to be released into mandatory supervision. Current statutes do not specifically include the determination of which inmates are to be released on mandatory supervision. H.B. 1584 requires the members of the board to determine which inmates are to be released on mandatory supervision. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 508.044(b), Government Code, to require board members, in addition to performing the duties imposed on the board by the Texas Constitution, to make certain determinations, including which inmates are to be released on parole or mandatory supervision. SECTION 2. Amends Section 508.153(a), Government Code, to make a conforming change. SECTION 3. Effective date: September 1, 2001.
