SRC-SEW H.B. 1586 77(R) BILL ANALYSIS Senate Research Center H.B. 1586 77R1824 YDB-DBy: Gallego (Madla) Intergovernmental Relations 4/19/2001 Engrossed DIGEST AND PURPOSE Currently, the Culberson County Hospital District (district) may acquire property, facilities, and equipment for the district to use in the hospital system. The Culberson County Hospital District board of directors (board) is authorized to lease hospital facilities and sell or otherwise dispose of property, facilities, or equipment on behalf of the district. As proposed, H.B. 1586 provides that the sale or disposal of property, facilities, or equipment must be at a public sale for the price and terms that the board determines are most advantageous to the district. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 5.06(b)-(d), Chapter 515, Acts of the 69th Legislature, Regular Session, 1985, as follows: (b) Authorizes the Culberson County Hospital District (district) board of directors (board) to lease or acquire property, facilities, and equipment for the use of the district and to mortgage or pledge the property, facilities, or equipment as security for the payment of the purchase price. Deletes language restricting use of property, facilities, and equipment to the hospital system. (c) Authorizes the board to sell, lease, or otherwise dispose of property, facilities, or equipment on behalf of the district. Requires sale or other disposal of the property, facilities, or equipment to be at a public sale and at a price and on the terms the board determines are most advantageous to the district. (d) Authorizes the board to donate to another governmental entity or to a charitable organization any surplus personal property or equipment if the donation serves a public purpose and is accompanied by adequate consideration. Deletes language regarding selling or otherwise disposing of property, facilities, or equipment on behalf of the district. SECTION 2. Effective date: upon passage or September 1, 2001.
