HBA-CMT H.B. 1586 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1586 By: Gallego County Affairs 3/5/2001 Introduced BACKGROUND AND PURPOSE Currently, the Culberson County Hospital District (district) may acquire property, facilities, and equipment for the district to use in the hospital system. The Culberson County Hospital District board of directors (board) is authorized to lease hospital facilities and sell or otherwise dispose of property, facilities, or equipment on behalf of the district. House Bill 1586 provides that the sale or disposal of property, facilities, or equipment must be at a public sale for the price and terms that the board determines are most advantageous to the district. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1586 amends law to provide that the sale or other disposal of the property, facilities, or equipment of the Culberson County Hospital District (district) must be at a public sale and at a price and on the terms the board of directors (board) of the district determines are most advantageous to the district. The board is authorized to donate any surplus personal property or equipment to another governmental entity or charitable organization if the donation serves a public purpose and is accompanied by adequate consideration. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001.
