HBA-DMH H.B. 1594 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1594 By: Dunnam Transportation 3/1/2001 Introduced BACKGROUND AND PURPOSE Under current law, a railway company commits an offense if a train of the company obstructs a street, railroad crossing, or public highway for more than 10 minutes. However, the law does not specifically address the policy of some railway companies to store railroad cars on the tracks. House Bill 1594 specifies that a railway company commits an offense if it allows a train to stand on a street, railroad crossing, or public highway for more than 10 minutes. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1594 amends the Transportation Code to provide that a railway company commits an offense if a train of the company is allowed to stand on a street, railroad crossing, or public highway for more than 10 minutes. EFFECTIVE DATE September 1, 2001.
