SRC-MWN H.B. 1613 77(R) BILL ANALYSIS Senate Research Center H.B. 1613 77R5325 MCK-DBy: Goolsby (Carona) Business & Commerce 5/9/2001 Engrossed DIGEST AND PURPOSE Under current law, the amount of time various licensees are required to retain records for inspection by the Texas Alcoholic Beverage Commission (TABC) differs. Creating consistency in the record keeping process will facilitate the record review process conducted by TABC and the comptroller of public accounts. H.B. 1613 requires beer manufacturers and distributors to retain certain records for inspection for at least four years. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 62.05(b), Alcoholic Beverage Code, to require all required records to be kept available for inspection by the Texas Alcoholic Beverage Commission (commission) or its authorized representatives during reasonable office hours for at least four, rather than two, years. SECTION 2. Amends Section 64.04(b), Alcoholic Beverage Code, to make a conforming change. SECTION 3. Effective date: September 1, 2001.
