SRC-MKV H.B. 1663 77(R) BILL ANALYSIS Senate Research Center H.B. 1663 77R2448 SGA-FBy: Alexander (Staples) Natural Resources 4/26/2001 Engrossed DIGEST AND PURPOSE The East Cedar Creek Fresh Water Supply District (district) was created by the Texas Legislature in 1977 and is located in Henderson County. Its primary function is to provide wastewater services to the inhabitants of the district. The district uses an irrigation system to dispose of discharged water from the plant. The irrigation system is used to grow hay on 137 acres that the district owns. Upon review of the district's original charter, the Texas Natural Resource Conservation Commission expressed the opinion that the district did not have the authority to package or market the hay. H.B. 1663 authorizes the district to package and market the hay. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 696, Acts of the 65th Legislature, Regular Session, 1977, by adding Section 5B, as follows: Sec. 5B. Authorizes the East Cedar Creek Fresh Water Supply District to produce agricultural products other than livestock on property it owns or controls and to market those products. SECTION 2. Effective date: upon passage or September 1, 2001.
