BACKGROUND AND PURPOSE 

Current law stipulates that no more than 40 percent of the individuals
attending a bingo occasion may use electronic or mechanical card minding
devices.  The percentage found in this section of bingo law was agreed to
by industry representatives at the time devices were new and being proposed
for use during bingo occasions.  House Bill 1795 removes the limitation on
the use of card minding devices to allow an unlimited number of persons to
use them at a bingo occasion.  

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 1795 amends the Occupations Code to delete the provision that no
more than 40 percent of the individuals attending a bingo occasion may use
electronic or mechanical card minding devices. 

EFFECTIVE DATE

On passage, or if the Act does not receive the necessary vote, the Act
takes effect September 1, 2001.
