SRC-JEC H.B. 1888 77(R) BILL ANALYSIS Senate Research Center H.B. 1888 By: Tillery (West) Intergovernmental Relations 4/25/2001 Engrossed DIGEST AND PURPOSE The Texas Local Fire Fighters Retirement Act defines the duties of the fire fighters' pension commissioner (commissioner). When some of the statutes were recodified, some of the duties of the commissioner were inadvertently removed. H.B. 1888 clarifies the commissioner's duties and adds to the general office duties of the commissioner. RULEMAKING AUTHORITY Rulemaking authority is expressly granted to the fire fighters' pension commissioner in SECTION 2 (Section 21A, Article 6243e, V.T.C.S.) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Repealer: Section 21(f), Texas Local Fire Fighters Retirement Act (Article 6243e, V.T.C.S.) (requiring the fire fighters' pension commissioner (commissioner) to hear appeals and authorizing the commissioner to examine the records and accounts of boards of trustees and adopt rules and prescribe forms for the administration of this Act). SECTION 2. Amends Section 21A, Texas Local Fire Fighters Retirement Act (Article 6243e, V.T.C.S.), by amending Subsections (f) and (g) and adding Subsection (h), as follows: (f) Requires the commissioner to hear appeals as provided by this Act. Authorizes the commissioner to examine the records and accounts of boards of trustees established under this Act and adopt rules and prescribe forms for the administration of this Act. Requires the commissioner to classify and coordinate the reports of the various boards of trustees and to verify any and all applications of the boards of trustees. Subsections (g) and (h) are redesignated from (f) and (g) with no changes in text. SECTION 3. Effective date: September 1, 2001.
