SRC-JEC H.B. 1890 77(R) BILL ANALYSIS Senate Research Center H.B. 1890 By: Lewis, Glenn (Harris) Intergovernmental Relations 5/10/2001 Engrossed DIGEST AND PURPOSE Under current law, a county sheriff has exclusive control over the funds of a county jail commissary. In a large county jail, the commissary generates significant revenue, creating the opportunity for mismanagement or abuse, with minimal oversight. H.B. 1890 grants authority over a county jail commissary located in a county with a population of one million or more to the commissioners court of the county. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 351C, Local Government Code, by adding Section 351.04155, as follows: Sec. 351.04155. COMMISSARY OPERATION BY SHERIFF IN CERTAIN COUNTIES. (a) Provides that this section applies only to a county that meets certain criteria. (b) Provides that the county is subject to Section 351.0415, with certain exceptions. SECTION 2. Repealer: Section 351.0415(e), Local Government Code. SECTION 3. Effective date: September 1, 2001.
