HBA-JEK H.B. 1970 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1970 By: Uher Public Education 3/26/2001 Introduced BACKGROUND AND PURPOSE A student may be expelled from school for certain serious offenses such as the possession of a firearm, selling an illegal drug or an alcoholic beverage, or abusing glue or aerosol paint on school property or at a school-sponsored activity. Current law does not include the possession or use of a BB gun in the serious offenses for which a student may be expelled from school. House Bill 1970 authorizes the expulsion of a student who uses, exhibits, or possesses a pellet gun, a BB gun, or a similar device. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1970 amends the Education Code to authorize the expulsion of a student who uses, exhibits, or possesses a pellet gun, a BB gun, or a similar device while on school property or while attending a school-sponsored or school-related activity on or off of school property. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001. This Act applies beginning with the 2001-2002 school year.
