The Texas Constitution authorizes the creation of groundwater conservation districts to plan, develop, and regulate the use of water. H.B. 2046 ratifies the creation of the Refugio Groundwater Conservation District (district), subject to voter approval at a confirmation election. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. RATIFICATION OF CREATION. Sets forth provisions regarding the creation of the Refugio Groundwater Conservation District (district). SECTION 2. DEFINITION. Defines "district." SECTION 3. BOUNDARIES. Provides that the boundaries of the district are coextensive with the boundaries of Refugio County, Texas. SECTION 4. GENERAL POWERS. Sets forth provisions regarding the powers of the district. SECTION 5. AUTHORITY TO SET FEES. Sets forth provisions regarding the authorization of the district to set certain fees. SECTION 6. BOARD OF DIRECTORS. Sets forth provisions regarding the board of directors. SECTION 7. METHOD OF ELECTING DIRECTORS: COMMISSIONERS PRECINCTS. Sets forth provisions regarding the election of directors. SECTION 8. CONFIRMATION AND INITIAL DIRECTORS' ELECTION. Sets forth provisions regarding the calling and holding of an initial election concerning the district. SECTION 9. ELECTION OF DIRECTORS. Sets forth provisions regarding the election of directors. SECTION 10. FINDINGS RELATED TO PROCEDURAL REQUIREMENTS. Provides that the proper and legal notice for the creation of the district has been furnished to certain persons and entities. SECTION 11. EXPIRATION OF ACT IF DISTRICT NOT CONFIRMED. Provides that this Act expires September 1, 2003, if the establishment of the district has not been conformed at a confirmation election held under Section 8 of this Act. SECTION 12. EFFECTIVE DATE: September 1, 2001.
