HBA-TBM H.B. 2057 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2057 By: Dunnam Pensions & Investments 3/2/2001 Introduced BACKGROUND AND PURPOSE Under current law, a retiree of the Teacher Retirement System of Texas (TRS) cannot be employed as a bus driver for a school district without losing retirement benefits. By allowing retirees to drive school buses, TRS can address a critical personnel shortage within the public school system of Texas without incurring any major adverse effect. House Bill 2057 authorizes a retiree of TRS to drive a school bus without losing retirement benefits. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2057 amends the Government Code to prohibit the Teacher Retirement System of Texas from withholding a monthly benefit payment of a member who is employed in a Texas public educational institution if the member has retired without a reduction for retirement at an early age and is employed as a bus driver for a school district on as much as a full-time basis. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001. The Act applies beginning with the 2001-2002 school year.
