HBA-CCH H.B. 2079 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2079 By: Reyna, Arthur Public Education 3/26/2001 Introduced BACKGROUND AND PURPOSE Current law authorizes the board of trustees of a school district to adopt a policy prohibiting students from possessing a paging device while on school property or while attending a school activity whether the activity is on or off school property. The law also authorizes a school to confiscate the paging device and to charge the owner an administrative fee before the device is released. House Bill 2079 removes the provision authorizing a school district to charge an administrative fee before releasing a confiscated paging device. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2079 amends the Education Code to remove the provision that authorizes a school district to charge the owner of a confiscated paging device or the student's parent an administrative fee not to exceed $15 before releasing the paging device. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001. This Act applies beginning with the 2001-2002 school year.
