DIGEST AND PURPOSE 

Current law authorizes Texas school districts to charge tuition for the
attendance of a student who is not domiciled in Texas and resides in
military housing that is exempt from taxation by the district. H.B. 2143
prohibits school districts from charging tuition to these students. 

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency.  

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 25.004, Education Code, as follows:

Sec. 25.004.  New heading: TUITION FOR CERTAIN MILITARY DEPENDENTS
PROHIBITED.  Prohibits a school district from charging tuition for the
attendance of a student who is domiciled in another state and resides in
military housing that is located in the district but is exempt from
taxation by the district.  Deletes text authorizing a district to charge
tuition and limiting the tuition rate. 

SECTION 2.  Makes this Act applicable beginning with the 2001-2002 school
year. 

SECTION 3.  Effective date: upon passage or September 1, 2001.
