SRC-BWC H.B. 2164 77(R) BILL ANALYSIS Senate Research Center H.B. 2164 By: Goolsby (Cain) Administration 5/11/2001 Engrossed DIGEST AND PURPOSE The property known as Woodlawn was purchased from The University of Texas System by the General Services Commission (GSC), which in turn deeded the property to the State Preservation Board (board). However, the board does not currently have the authority to dispose of the property. H.B. 2164 authorizes the board to sell Woodlawn at its fair market value and requires the proceeds from the transaction to be deposited in the capitol renewal account or its successor. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends 443.025, Government Code, to authorize the State Preservation Board (board) to sell Woodlawn at its fair market value. Requires the General Land Office to transact the sale on behalf of the board using procedures under Section 31.158(c), Natural Resources Code. Provides that proceeds from the transaction are required to be deposited in the Capitol renewal account or its successor in function under Section 443.0103 and the proceeds are authorized to be spent only for a purpose described by Section 443.0103. Requires the board, in selling Woodlawn under this section, to add to the deed of Woodlawn a provision that requires the purchaser to use the property in a manner that preserves the historical character of Woodlawn, including its buildings, facades, interior, and grounds. SECTION 2. Effective date: upon passage or September 1, 2001.
