HBA-TBM H.B. 2199 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2199 By: Homer Pensions & Investments 4/19/2001 Introduced BACKGROUND AND PURPOSE Under current law, members of the Teacher Retirement System of Texas (TRS) who accumulate 50 days or more or 400 hours or more of unused personal or sick leave are entitled upon retirement to purchase one year of service credit for the actuarial equivalent of the benefit. However, the leave time was already earned by the member. As such, a member should not be required to pay to receive the benefit. House Bill 2199 removes provisions requiring a member of TRS to pay for service credit granted for accumulated state personal or sick leave upon retirement. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2199 amends the Government Code to remove provisions requiring a member of the Teacher Retirement System of Texas to pay for service credit granted for accumulated state personal or sick leave upon retirement. EFFECTIVE DATE September 1, 2001.
