SRC-SEW C.S.H.B. 2262 77(R)BILL ANALYSIS Senate Research CenterC.S.H.B. 2262 77R15088 JMM-FBy: Danburg (Madla) Intergovernmental Relations 5/8/2001 Committee Report (Substituted) DIGEST AND PURPOSE C.S.H.B. 2262 modifies the requirements for membership on the Texas Optometry Board by eliminating references to the Texas Optometric Association, Inc., and the Texas Association of Optometrists, Inc. RULEMAKING AUTHORITY Rulemaking authority previously granted to the Texas Optometry Board is modified in SECTION 5 (Section 351.151, Occupations Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 351.051(a), Occupations Code, to provide that the Texas Optometry Board (board) consists of nine members appointed by the governor with the advice and consent of the senate, with six (rather than three) optometrists or therapeutic optometrists and three members who represent the public. Deletes text regarding the Texas Optometric Association, Inc. and the Texas Association of Optometrists, Inc. SECTION 2. Amends Section 351.052, Occupations Code, to delete existing Subsection (b) and make nonsubstantive changes. SECTION 3. Amends Section 351.054(a), Occupations Code, to make conforming changes. SECTION 4. Amends Section 351.055, Occupations Code, to delete existing Subsection (b) and make nonsubstantive changes. SECTION 5. Amends Section 351.151, Occupations Code, to authorize the board by a majority vote of a quorum to adopt procedural and substantive rules. Deletes text regarding the condition that a majority of each of the three groups represented on the board vote to adopt the rule. Makes nonsubstantive changes. SECTION 6. Amends Section 351.152, Occupations Code, to make a conforming change. SECTION 7. Makes the change in law made by this Act prospective regarding the appointment of a person as a member of the Texas Optometry Board on or after the effective date of this Act. Provides that the eligibility of a person serving as a member of the Texas Optometry Board on the effective date of this Act is governed by the law in effect immediately before the effective date of this Act and, unless removed as otherwise provided by law, the person may continue to serve for the remainder of the person's term. SECTION 8. Effective date: upon passage or September 1, 2001.
