DIGEST AND PURPOSE 

Current law authorizes the board of trustees of a school district (board)
to obtain insurance against bodily injuries sustained by students while
training for or engaging in interschool athletic competition. However,
students can be injured while participating in various school functions.
H.B. 2301 authorizes the board to obtain insurance against bodily injuries
sustained by students while engaging in schoolsponsored activities on a
school campus.  

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 33.085, Education Code, as follows:

Sec. 33.085. New heading: INSURANCE FOR CERTAIN SCHOOL ACTIVITIES. (a)
Authorizes the board of trustees of a school district, in compliance with
this section, to obtain insurance against bodily injuries sustained by
students while training for or engaging in interschool athletic competition
or while engaging in school-sponsored activities on a school campus. 

(d) Provides that the cost of the insurance is a legitimate part of the
total cost of operating the school district. Deletes text regarding
athletic program. 

SECTION 2. Effective date: September 1, 2001.
                      Makes application of this Act prospective.
