SRC-SEW H.B. 2313 77(R) BILL ANALYSIS Senate Research Center H.B. 2313 By: Bosse (Gallegos) State Affairs 5/8/2001 Engrossed DIGEST AND PURPOSE The Vehicle Storage Facility Act provides for the regulation of proper motor vehicle storage. However, some feel that the Transportation Code does not adequately address the disposal of abandoned nuisance motor vehicles and does not provide communities and vehicle storage facilities with the authority to dispose of such vehicles in an expeditious fashion. H.B. 2313 establishes provisions for the disposal of nuisance motor vehicles by vehicle storage facilities. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 683.001, Transportation Code, by adding Subdivisions (9) and (10) to define "abandoned nuisance vehicle" and "vehicle storage facility," respectively. SECTION 2. Amends Section 683.012, Transportation Code, by adding Subsection (e) to provide that a law enforcement agency is not required to send a notice, as otherwise required by Subsection (a), if the agency has received notice from a vehicle storage facility that an application has or will be submitted to the department or a law enforcement agency for the disposal of an abandoned nuisance vehicle. SECTION 3. Amends Section 683.034(e), Transportation Code, to authorize the storage facility, if the law enforcement agency does not take the vehicle into custody before the 31st day after the date notice is sent under Section 683.012, to dispose dispose of the vehicle under: Chapter 70, Property Code, except that notice under Section 683.012 satisfies the notice requirements of that chapter; or the Vehicle Storage Facility Act (Article 6687-9a, Revised Statutes), under certain conditions. SECTION 4. Effective date: September 1, 2001.
