SRC-MKV H.B. 2316 77(R) BILL ANALYSIS Senate Research Center H.B. 2316 By: McClendon (Van de Putte) Natural Resources 5/6/2001 Engrossed DIGEST AND PURPOSE Currently, the General Services Commission (commission) owns an area of unused property located in the City of San Antonio which could be used by Bethel African Methodist Episcopal Church (Bethel AME). H.B. 2316 authorizes the commission to convey that property to Bethel AME for consideration in an amount that is equal to at least the fair market value of the real property. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. (a) Authorizes the General Services Commission to convey, on behalf of the state, the state's interest in the real property described in Subsection (e) of this section to Bethel African Methodist Episcopal Church, in San Antonio, Bexar County, Texas. (b) Sets forth provisions relating to the purchase and sale agreement relating to the conveyance authorized by this section. (c) Authorizes the General Services Commission to transfer the property only by a special warranty deed. (d) Provides that Sections 31.158 (Real Estate Transaction Authorized by Legislature), 31.159 (First Option to Purchase), and 31.161 through 31.167 (relating to development plans), Natural Resources Code, do not apply to the conveyance authorized by this section. (e) Provides that the real property to which Subsection (a) of this section refers is described as follows: Lot 1 and the West 25 feet of Lot 2, Block 9, New City Block 582, in the City of San Antonio, Bexar County, Texas. SECTION 2. Effective date: September 1, 2001.
