SRC-SEW H.B. 2347 77(R) BILL ANALYSIS Senate Research Center H.B. 2347 77R7876 JMG-DBy: Raymond (Zaffirini) Intergovernmental Relations 5/7/2001 Engrossed DIGEST AND PURPOSE Under current law, the Webb County Commissioner Court is authorized to impose a courthouse security fee not to exceed $20 to be collected at the time of filing in each civil case filed in the county court, a county court at law, or a district court in Webb County. Also the commissioners court of any county may set a security fee not to exceed $5 to be collected at the time of filing in each civil case filed. It is unclear whether the law allows Webb County to charge a maximum of $20 or $25 for a security fee. H. B. 2347 clarifies the provisions and authorizes Webb County to charge a maximum $20 security fee. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 291.009(a), Local Government Code, to authorize the Webb County Commissioners Court, in addition to any other fee authorized by law, including a fee for security under Section 291.008, to set a fee not to exceed $20 to be collected at the time of filing in each civil case filed in the county court, a county court at law, or a district court in Webb County. SECTION 2. Effective date: upon passage or September 1, 2001.
