HBA-MSH H.B. 2347 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2347 By: Raymond County Affairs 3/25/2001 Introduced BACKGROUND AND PURPOSE Under current law, the Webb County Commissioner Court is authorized to impose a courthouse security fee not to exceed $20 to be collected at the time of filing in each civil case filed in the county court, a county court at law, or a district court in Webb County. Also the commissioners court of any county may set a security fee not to exceed $5 to be collected at the time of filing in each civil case filed. It is unclear whether the law allows Webb County to charge a maximum of $20 or $25 for a security fee. House Bill 2347 clarifies the provisions and authorizes Webb County to charge a maximum $25 security fee. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2347 amends the Local Government Code to authorize the Webb County Commissioners Court to set a courthouse security fee in addition to any security fee authorized by law to be collected at the time of filing in each civil case in the county court. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001.
