HBA-JEK H.B. 2360 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2360 By: Isett State, Federal & International Relations 4/1/2001 Introduced BACKGROUND AND PURPOSE Monuments and memorials that honor Texans for their military service serve as a reminder of the sacrifices and contributions that have been made by the men and women of this state. Many of the monuments and memorials that honor veterans are located on state property. House Bill 2360 authorizes the removal, relocation, or alteration of certain monuments and memorials located on state property, only by certain agencies with the intent to repair or improve or to relocate it to another equally prominent location. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2360 amends the Government Code to authorize the removal, relocation, or alteration of a monument or memorial only by the legislature, the Texas Historical Commission, the State Preservation Board, or to accommodate the construction, repair, or improvement of the monument, memorial, or the surrounding state property. The bill provides that any monument or memorial that is permanently removed must be relocated to an equally prominent location determined by the legislature. EFFECTIVE DATE September 1, 2001.
