SRC-MKV H.B. 2437 77(R) BILL ANALYSIS Senate Research Center H.B. 2437 77R7896 JRD-DBy: Davis, Yvonne (Carona) Health & Human Services 4/26/2001 Engrossed DIGEST AND PURPOSE Currently, the Code Enforcement Association of Texas (CEAT) offers certification courses to registered code enforcement officers (officers) in conjunction with the Texas Engineering Extension Service of Texas A&M University. CEAT offers an initial training course for the officers to be certified. Each year thereafter, an officer is required to pay a registration fee to renew their certification, but no additional training is required by law. Without this additional training, officers may not be aware of changes in law that apply to code enforcement. H.B. 2437 requires the Texas Board of Health to establish a continuing education program for officers required for certification renewal. RULEMAKING AUTHORITY Rulemaking authority is expressly granted to the Texas Board of Health in SECTION 1 (Section 4(a), Chapter 796, Acts of the 72nd Legislature, Regular Session, 1991 (Article 4447bb, V.T.C.S.)) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 4(a), Chapter 796, Acts of the 72nd Legislature, Regular Session, 1991 (Article 4447bb, V.T.C.S.), to change a reference from "the Position Classification Act of 1961 (article 6252-11, V.T.C.S.)" to "Chapter 654, Government Code." Adds language to require the Texas Board of Health (board) by rule to prescribe annual continuing education requirements for code enforcement officers and code enforcement officers in training that meet certain requirements. SECTION 2. Amends Section 7(a), Chapter 796, Acts of the 72nd Legislature, Regular Session, 1991 (Article 4447bb, V.T.C.S.), to add language authorizing a certificate of registration under this Act to be renewed on completion of the annual continuing education requirements prescribed by the board. SECTION 3. Makes application of this Act prospective. SECTION 4. Effective date: September 1, 2001.
