DIGEST AND PURPOSE 

H.B. 2488 authorizes the Donley Hospital District to issue revenue bonds
for the purpose of refunding any previously issued revenue bond and to
contract with the Texas Department of Human Services to lease the
district's buildings and facilities.  

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency.  

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 699, Acts of the 61st Legislature, Regular
Session, 1969, by amending Sections 7 and 8, and adding Section 24, as
follows: 

Sec. 7.  Authorizes the board of directors (board) of the Donley County
Hospital District (district) to issue revenue bonds for the purpose of
refunding any previously issued bonds and to issue revenue bonds for the
purpose of purchasing, constructing, acquiring, repairing, equipping, or
renovating buildings and improvements for the district's facilities for the
district's hospital system, rather than hospital purposes.  Modifies
statutory references. 

Sec. 8.  Authorizes the hospital system, as determined by the board, to
include certain facilities. Authorizes the district to contract with the
Texas Department of Human Services to lease all or part of its buildings
and facilities upon certain terms and conditions. 

Sec. 24.  Provides that all proceedings, resolutions, orders, and other
acts or attempted acts of the district in the issuance of notes, and all
proceedings of the district authorizing the issuance, execution, and
delivery of notes and other obligations of the district are validated in
all respects and are valid as though the notes had been originally and duly
authorized, accomplished, validated, ratified, approved, and confirmed. 

SECTION 2.  Provides that this Act does not apply to any matter involved in
litigation on the effective date of this Act if the litigation ultimately
results in the matter being held invalid in a final judgment of a court of
competent jurisdiction. 

SECTION 3.  Effective date: upon passage or September 1, 2001.
