SRC-MWN H.B. 2491 77(R) BILL ANALYSIS Senate Research Center H.B. 2491 By: Bosse (Whitmire) Natural Resources 5/2/2001 Engrossed DIGEST AND PURPOSE Since 1991, the Harris County Water Control and Improvement District No. 84 (district) has been operating in the unincorporated Channelview area of Harris County, Texas. Since the creation of the district, subsequent annexations of land have been made and certain descriptions of current metes and bounds have been construed as ambiguous. H.B. 2491 modifies the legal description of the district and validates all annexations of new tracts into the district. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. DEFINITION. Defines "district." SECTION 2. VALIDATION. Sets forth provisions regarding the validation of the district. SECTION 3. LEGAL DESCRIPTION. Sets forth provisions regarding the boundaries of the district. SECTION 4. FINDINGS RELATIVE TO BOUNDARIES. Sets forth provisions regarding the findings relative to district boundaries. SECTION 5. EFFECT OF LITIGATION. Provides that this Act does not apply to certain matters under litigation. SECTION 6. PENDING ANNEXATIONS. Sets forth criteria regarding pending annexations by the district. SECTION 7. Repealer: Chapter 878(3) (Legal Description), Acts of the 72nd Legislature, Regular Session, 1991. SECTION 8. EFFECTIVE DATE: upon passage or September 1, 2001.
