BACKGROUND AND PURPOSE 

Current law enables political subdivisions to acquire and convey land or
real property interest to an entity for the development of low-income or
moderate-income housing, and to convey land for less than its fair market
value if conveyance of the land would serve a public purpose.  However, the
current statute is unclear as to whether all political subdivisions
including counties and school districts are able to participate in such
transactions.  House Bill 2644 clarifies that all political subdivisions
are authorized to sell land at less than fair market value to an entity for
the development of low-income to moderate-income housing. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 2544 amends the Local Government Code to provide that any
political subdivision that has acquired or assembled land or real property
interest except by condemnation and sells, exchanges, or otherwise conveys
the land or interests to an entity for the development of low-income or
moderate-income housing is required to determine the terms and conditions
of the transactions so as to effectuate and maintain the public purpose. 

EFFECTIVE DATE

On passage, or if the Act does not receive the necessary vote, the Act
takes effect September 1, 2001.
