SRC-JEC H.B. 2559 77(R) BILL ANALYSIS Senate Research Center H.B. 2559 77R5557 MRB-DBy: Jones, Elizabeth (Shapiro) Intergovernmental Relations 5/4/2001 Engrossed DIGEST AND PURPOSE Currently, municipal courts have jurisdiction beyond the areas of interest of a city in cases related to the Alcoholic Beverage Code. H.B. 2559 aligns two separate jurisdictions of municipal courts into a single concurrent jurisdiction, limiting the power of a city beyond its extraterritorial jurisdiction. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 29.003(b), Government Code, to provide that the municipal court has concurrent jurisdiction with the justice court of a precinct in which the municipality is located in all criminal cases arising under state law that arise within the municipality's territorial limits or property owned by the municipality located in the municipality's extraterritorial jurisdiction and that: are punishable only by a fine as described in Subsection (c); or arise under Chapter 106 (Provisions Relating to Age), Alcoholic Beverage Code, and do not include confinement as an authorized sanction. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 2001.
