HBA-SEP H.B. 2591 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2591 By: Davis, John Juvenile Justice & Family Issues 3/18/2001 Introduced BACKGROUND AND PURPOSE Current law does not require a parent subject to an order to pay child support to provide notice of a change in residence and address information to the other parent to maintain a record of the notice and of the manner in which the notice was provided, nor does current law provide a penalty for failing to provide the notice. House Bill 2591 provides that it is a Class B misdemeanor for a parent to fail to provide the notice and increases the penalty from a Class C misdemeanor to a Class B misdemeanor for a parent who fails to notify the other parent that the parent resides with a person the parent knows is registered as a sex offender or is currently charged with an offense for which on conviction the person would be required to register as a sex offender. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2591 amends the Family Code to require a parent subject to an order to pay child support to provide notice of a change in residence and address information to the other parent to maintain a record of the notice and the manner in which the notice was provided. The bill provides that it is a Class B misdemeanor if a person fails to provide the notice of residence and address information in the required manner to the other parent. The bill increases the penalty from a Class C misdemeanor to a Class B misdemeanor if a parent fails to provide notice to the other parent in the required manner that the parent resides with a person the parent knows is registered as a sex offender or is currently charged with an offense for which on conviction the person would be required to register as a sex offender. EFFECTIVE DATE September 1, 2001.
