DIGEST AND PURPOSE 

Historically, the Dallas County Child Support Office (office) was
responsible for receiving and distributing child support payments ordered
by the family district courts.  In recent years, the office has taken on
the role of monitoring and assisting custodial parents in the process of
obtaining their child support and reporting this information to the
district court and commissioners court.  The Personal Responsibility and
Work Opportunity Reconciliation Act of 1996 now requires each state to
operate a state disbursement unit to receive and disburse child support
payments.  H.B. 2638 authorizes the Dallas County Child Support Office to
collect specified fees for monitoring spousal maintenance or child support
payments in Dallas County.  

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 152.0633(g), Human Resources Code, to provide
that the Department of Human Services (department) has the duties assigned
by the administrator or the local administrative judge and prescribed by
this section and Section 152.0634, including the duty to collect, receive,
disburse, and monitor support payments that are required by court order to
be made to the department. 

SECTION 2.  Amends Section 152.0634(b), Human Resources Code, to make a
conforming change.   

SECTION 3.  Amends Section 152.0635(a), Human Resources Code, to make a
conforming change. 

SECTION 4.  Provides that the change in law made by Sections 152.0633,
152.0634, and 152.0635, Human Resources Code, as amended by this Act, apply
only to a fee due on or after the effective date of this Act. 

SECTION 5.  Effective date: September 1, 2001.
