BACKGROUND AND PURPOSE 

Currently, the Texas Education Agency makes grants to school districts and
open-enrollment charter schools to implement or expand kindergarten and
prekindergarten classes for the purpose of operating an existing half-day
kindergarten or prekindergarten program on a full-day basis.  The grants
are awarded to district and open-enrollment charter schools that have
students who are performing substantially below average.  House Bill 2707
provides that a prekindergarten class that previously received funding from
a grant for the expansion of its operation to a full-day program may
continue to operate on a full-day basis. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 2707 amends the Education Code to provide that a prekindergarten
class that previously received funding from a prekindergarten grant to
expand its operation to a full-day  period may continue to operate on a
full-day basis under the Foundation School Program. 

EFFECTIVE DATE

On passage, or if the Act does not receive the necessary vote, the Act
takes effect September 1, 2001.
