SRC-SEW H.B. 2760 77(R) BILL ANALYSIS Senate Research Center H.B. 2760 77R4178 MI-FBy: Brown, Betty (Madla) Intergovernmental Relations 5/9/2001 Engrossed DIGEST AND PURPOSE Current law provides that it is the policy of this state that disputes before governmental bodies be resolved as fairly and expeditiously as possible and that each governmental body support this policy by developing and using alternative dispute resolution procedures in appropriate aspects of the governmental body's operations and programs. However, provisions regulating interlocal cooperation contracts do not provide for the application of existing alternative dispute resolution procedures. H.B. 2760 authorizes parties to an interlocal cooperation contracts to use alternative dispute resolution procedures. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 791B, Government Code, by adding Section 791.015, as follows: Sec. 791.015. SUBMISSION OF DISPUTES TO ALTERNATIVE DISPUTE RESOLUTION PROCEDURES. Authorizes local governments that are parties to an interlocal contract to provide in the contract for the submission of disputes arising under the contract to the alternative dispute resolution procedures authorized by Chapter 2009. SECTION 2. Effective date: September 1, 2001.
