SRC-MWN H.B. 2761 77(R) BILL ANALYSIS Senate Research Center H.B. 2761 77R5149 SGA-FBy: Brown, Betty (Cain) Natural Resources 5/9/2001 Engrossed DIGEST AND PURPOSE The Texas Water Rights Commission by court order converted Kaufman County Levee Improvement District No. 4 to the Kaufman County Municipality Utility District No. 1 in 1975 for the purpose of supplying water as well as flood control in a defined area in Kaufman County. The district does not and is not planning to supply water to any area in Kaufman County. H.B. 2761 converts the Municipality Utility District No.1 to the Kaufman County Levee Improvement District No. 4. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. CONVERSION OF DISTRICT. Provides that the Kaufman County Municipal Utility District No. 1 (district) is converted to a levee improvement district and has the rights, powers, privileges, authority, and functions conferred by Chapter 57 (Levee Improvement Districts), Water Code. SECTION 2. DEFINITION. Defines "improvement district." SECTION 3. NAME CHANGE. Provides that a reference to another law to the district means the Kaufman County Levee Improvement District No. 4. SECTION 4. BOARD OF DIRECTORS. Sets forth provisions regarding the board of directors of the district. SECTION 5. FINDINGS RELATED TO PROCEDURAL REQUIREMENTS. Sets forth findings providing that the required notice to certain persons and entities has been made. SECTION 6. EFFECTIVE DATE: September 1, 2001.
