HBA-CBW H.B. 2857 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2857 By: Seaman Land & Resource Management 4/4/2001 Introduced BACKGROUND AND PURPOSE Under current law, counties have the ability to delegate dune protection authority to one or more municipalities in the county. Within city limits and extraterritorial jurisdictions, cities already have building inspection, permitting, and beachfront construction certificate authority. However, these same municipalities do not have dune protection within the city limits or extraterritorial jurisdiction unless a county specifically delegates the authority. House Bill 2857 requires a county to allow a municipality to establish a dune protection line within its corporate limits and extraterritorial jurisdiction. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2857 amends the Natural Resources Code to require a county, at the request of the governing body of a municipality, rather than at the county's discretion, to allow a municipality within the county to establish a dune protection line within its corporate limits and extraterritorial jurisdiction. EFFECTIVE DATE September 1, 2001.
