HBA-NRS C.S.H.B. 2863 77(R)BILL ANALYSIS Office of House Bill AnalysisC.S.H.B. 2863 By: Farabee County Affairs 4/8/2001 Committee Report (Substituted) BACKGROUND AND PURPOSE Legislation passed last session raised the threshold for purchases from $15,000 to $25,000 at which a county must comply with competitive bidding or competitive proposal procedures. However, certain statutes within the Transportation and Local Government codes still make reference to the $15,000 limit for certain expenditures. C.S.H.B. 2863 increases the threshold in relevant statutes to $25,000. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS C.S.H.B. 2863 amends the Local Government and Transportation codes relating to county competitive purchases. The bill increases the maximum amount that a county may expend without being subject to competitive sealed bidding or sealed proposal requirements, to $25,000. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001. COMPARISON OF ORIGINAL TO SUBSTITUTE The substitute modifies the original bill to conform to Texas Legislative Council style and format.
