HBA-NRS H.B. 2863 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2863 By: Farabee County Affairs 4/1/2001 Introduced BACKGROUND AND PURPOSE Legislation passed last session raised the threshold for purchases from $15,000 to $25,000 at which a county must comply with competitive bidding or competitive proposal procedures. However, certain statutes within the Transportation and Local Government codes still make reference to the $15,000 limit for certain expenditures. House Bill 2863 increases the threshold in relevant statutes to $25,000. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 2863 amends the Local Government and Transportation codes relating to county competitive purchases. The bill increases the maximum amount that a county may expend without being subject to competitive sealed bidding or sealed proposal requirements, to $25,000. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001.
