DIGEST AND PURPOSE 

The State Preservation Board (board) was established in 1983 by the 68th
Legislature for the purpose of preserving, maintaining, and restoring the
State Capitol and the General Land Office Building and their contents and
grounds. In 1997, the 75th Legislature approved the Bob Bullock Texas State
History Museum and authorized the board to manage the design, construction,
and governance of the museum.  H.B. 2877 sets forth modified provisions for
the operations, powers, and duties of the board.  

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a
state officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 443.006, Government Code, to require the curator
of the Capitol to develop the collections policy with the assistance of a
review committee composed of five members whose qualifications, tenure, and
duties are defined by the executive director.  Provides that Chapter 210
does not apply to the review committee.  Deletes text that required the
curator to approve all exhibits placed in the buildings and make a good
faith effort to assist Texas businesses to receive a percentage of the
total of certain contracts. 

SECTION 2.  Amends Chapter 443, Government Code, by adding Section
443.0153, as follows: 

Sec. 443.0153.  PARKING FEES NOT SUBJECT TO SALES TAX.  Provides that
parking fees paid through parking meters maintained under this chapter and
parking fees paid in a visitor parking facility under this chapter or
Chapter 445 are exempt from the application of the tax imposed by Chapter
151 (Limited Sales, Excise, and Use Tax), Tax Code. 

SECTION 3.  Amends Section 443.023, Government Code, to provide that Title
10D does not apply to a purchase or lease under this chapter.  Authorizes
the executive director, as appropriate, to approve in writing the purchase
or lease of goods and services needed to repair or improve an area within
the Capitol, Capitol extension, Capitol grounds, or General Land Office
building, if the cost of the purchase or lease will not exceed $50,000,
rather than $15,000.  Requires the executive director to notify the State
Preservation Board in writing of any expenditures in excess of $50,000,
rather than $15,000, made under this chapter. 

SECTION 4.  Amends Chapter 443, Government Code, by adding Section
443.0231, as follows: 

Sec. 443.0231.  INFORMATION TECHNOLOGIES.  Provides that Chapter 2054 does
not apply to the board.   

SECTION 5.  Amends Section 443.025(a), Government Code, to authorize,
rather than require, the board to preserve, maintain, and restore Woodlawn,
also know as Pease Mansion and Shivers Mansion. 
 
SECTION 6.  Amends Chapter 411F, Government Code, by adding Section
411.1145, as follows: 

Sec. 411.1145.  ACCESS TO CRIMINAL HISTORY RECORD INFORMATION: STATE
PRESERVATION BOARD.   Provides that the board is entitled to obtain
criminal history record information maintained by the Department of Public
Safety that relates to a person who is an employee, volunteer, or intern,
or an applicant to be an employee, volunteer, or intern, in a position that
involves certain responsibilities of an office.  Prohibits a criminal
history record information obtained by the board from being released or
disclosed to any person except on court order or with the consent of the
person who is the subject of the information. 

SECTION 7.  Amends Section 445.011, Government Code, to authorize the Bob
Bullock Texas State History Museum (museum) to establish a membership
program.  Provides that notwithstanding other law, for purposes of Chapter
659H, as added by Chapter 76, Acts of the 74th Legislature, Regular
Session, 1995, the museum is considered an eligible charitable organization
entitled to participate in a state employee charitable campaign under
Chapter 659H, and a state employee is entitled to authorize a deduction,
for museum purposes, for contributions to the museum, including
contributions for museum membership, as a charitable contribution under
Section 659.132. 

SECTION 8.  Repealers:   Sections 443.0101(d) (Capitol Fund), 445.002(c)
(Governance), and 445.012(d) (Museum Fund), Government Code. 

SECTION 9.  Provides that the Bob Bullock Texas State History Museum is
entitled to participate in the state employee charitable campaign conducted
during the autumn of 2001 without regard to any limitation on the time
during which an organization must apply to participate in the campaign. 

SECTION 10.  Effective date: upon passage or the 91st day after the last
day of the legislative session.  


SUMMARY OF COMMITTEE CHANGES

Differs from As Filed version by deleting proposed SECTION 3 and adding a
new SECTION 3 regarding purchase and lease requirements for certain
expenditures.
