BACKGROUND AND PURPOSE 

The Texas Alcoholic Beverage Commission (commission) is composed of three
members appointed by the governor.  The commission is required to inspect,
supervise, and regulate every phase of the business of manufacturing,
importing, exporting, transporting, storing, selling, advertising,
labeling, and distributing of alcoholic beverages, and the possession of
alcoholic beverages for the purpose of sale or otherwise. With only three
members, the commission is unable to reflect the increasing population and
diversity of the state.  House Bill 3033 increases the number of members of
the commission and requires the governor to attempt to reflect the
geographic diversity of the state. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

House Bill 3033 amends the Alcoholic Beverage Code to increase the number
of members of the Texas Alcoholic Beverage Commission (commission) from
three to six.  The bill requires the governor to attempt to reflect the
geographic diversity of the state in making appointments to the commission.
The bill provides that the terms of two members of the commission rather
than one expire every two years. 

EFFECTIVE DATE

September 1, 2001.
