HBA-TBM H.B. 3068 77(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 3068 By: Chisum County Affairs 7/25/2001 Enrolled BACKGROUND AND PURPOSE Prior to the 77th Legislature, county auditors in counties with populations of less than 10,000 were selected by a bifurcated process requiring a request for appointment by the county commissioners court and a judicial review by district judges. The law also required the commissioners court to determine that a county auditor was necessary to carry out county business and order the appointment into its minutes. The order must then have been certified and the district judges must have found that the reasons for the request were good and sufficient. This process may benefit counties with a slightly larger population. House Bill 3068 increases this population guideline for the appointment of county auditors from 10,000 to 10,200. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 3068 amends the Local Government Code to increase the county population guideline regarding the appointment of a county auditor from 10,000 to 10,200. EFFECTIVE DATE September 1, 2001.
