SRC-MWN H.B. 3081 77(R) BILL ANALYSIS Senate Research Center H.B. 3081 By: Burnam (Moncrief) Business & Commerce 5/11/2001 Engrossed DIGEST AND PURPOSE Current law provides that an entity that stores, repairs, or performs maintenance work on an aircraft has a lien on the aircraft for the amount specified in the contract or the amount reasonably charged for those services. However, current law does not extend this authority to an aircraft fuel vendor. H.B. 3081 enables an aircraft fuel vendor to hold a lien on the aircraft for the amount charged for the fuel. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, agency, or institution. SECTION BY SECTION ANALYSIS H.B. 3081 amends the Property Code to provide that a person who fuels an aircraft has a lien on the aircraft for the amount due under a contract or, if there is no amount specified in the contract, reasonable and usual compensation for the fuel. Effective date: September 1, 2001. Makes application of this Act prospective.
